Terms of Service

1. Acceptance and eligibility

By downloading, accessing, purchasing, or using xVPN products and services (together, the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

You must be legally capable of entering into this agreement and meet the minimum age required in your country. If you use the Services for an organization, you confirm that you have authority to bind that organization.

2. The Service and your license

Subject to these Terms, xVPN grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Services for lawful purposes.

The Services may include VPN connectivity, server selection, security and privacy features, account functions, applications, websites, and subscription benefits. Available features may vary by platform, plan, region, or app-store rules.

3. Accounts and security

You are responsible for the accuracy of account information you provide, for keeping credentials confidential, and for activity performed through your account. Notify us promptly if you believe your account or subscription has been compromised.

You may not sell, rent, transfer, or provide unauthorized access to your account. We may require reasonable verification before assisting with account access or a privacy request.

4. Subscriptions, billing, cancellation, and refunds

Prices, billing periods, included features, renewal terms, taxes, and introductory offers are shown before purchase. Unless stated otherwise, a paid subscription renews automatically until cancelled through the purchase channel before the renewal date.

Purchases made through an app store are billed, cancelled, and refunded under that store’s rules. Other purchases are governed by the terms shown at checkout and applicable law. Fees already charged are non-refundable except where the purchase terms or law require otherwise.

Changes to a plan or price will be communicated as required and ordinarily apply from a future billing period.

5. Acceptable use

You must use the Services lawfully. You may not use or attempt to use the Services to:

• Violate applicable law or another person’s rights, including intellectual property, privacy, or data protection rights.
• Distribute malware, conduct phishing, send spam, operate botnets, or interfere with systems, networks, or users.
• Gain unauthorized access, probe vulnerabilities without permission, bypass technical restrictions, or attack infrastructure.
• Exploit, harass, threaten, defraud, or facilitate harm to another person.
• Resell or commercially exploit the Services unless xVPN has authorized it in writing.
• Reverse engineer, modify, copy, scrape, or automatically access the Services except where applicable law expressly permits it.

xVPN is a privacy tool and does not authorize conduct that would otherwise be unlawful. We may investigate credible abuse reports and restrict access when reasonably necessary to protect the Services or comply with law.

6. Ownership and intellectual property

The Services and their software, interface, text, graphics, logos, trademarks, designs, documentation, and other content are owned by or licensed to xVPN and are protected by intellectual property laws.

Except for the limited license in these Terms, no right or ownership interest is transferred to you. Feedback you voluntarily submit may be used by xVPN without restriction or payment, provided we handle related personal information under our Privacy Policy.

7. Privacy

Our Privacy Policy explains what information we process, why we process it, how long it may be retained, and the choices available to you. The Privacy Policy is incorporated into these Terms by reference.

No internet transmission or security technology is guaranteed to be completely secure. You are responsible for assessing whether the Services meet your needs and for using appropriate device and account security.

8. Third-party services

The Services may link to or interoperate with app stores, payment providers, websites, platforms, or other third-party services. Their terms and privacy practices govern your use of those services. xVPN does not control and is not responsible for third-party content, availability, or practices.

9. Service availability and changes

We work to keep the Services available and reliable, but we do not guarantee uninterrupted access, a particular server, location, speed, protocol, or compatibility. Maintenance, emergencies, legal requirements, security risks, or third-party dependencies may affect availability.

We may add, change, suspend, or discontinue features. Where a material change adversely affects a paid subscription, we will provide notice or a remedy when required by law.

10. Suspension and termination

You may stop using the Services at any time and may cancel a subscription through the relevant purchase channel. Deleting an app does not automatically cancel a subscription.

We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay applicable fees, or misuse the Services. Where appropriate, we will provide notice and an opportunity to resolve the issue.

Provisions that by their nature should continue after termination—including ownership, disclaimers, liability limits, indemnification, and dispute provisions—will survive.

11. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” xVPN disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

xVPN does not guarantee that the Services will make you anonymous, prevent every threat, or make otherwise unlawful conduct lawful. Some jurisdictions do not allow certain warranty exclusions, so these exclusions may not fully apply to you.

12. Limitation of liability

To the maximum extent permitted by law, xVPN and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for lost profits, revenue, data, goodwill, or business interruption arising from the Services.

To the maximum extent permitted by law, total liability arising from the Services will not exceed the amount you paid for the Services during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited, including certain consumer rights or liability for fraud or willful misconduct.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless xVPN and its affiliates, personnel, licensors, and providers from third-party claims and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Where permitted by applicable law, courts and enforcement offices in İstanbul have exclusive jurisdiction.

Mandatory consumer protections and your right to bring a claim in another competent forum are not excluded where local law does not permit that exclusion. Before filing a formal claim, you and xVPN agree to make a reasonable good-faith effort to resolve the issue informally.

15. Changes and general terms

We may update these Terms to reflect changes in law, the Services, or our practices. We will publish the revised Terms and update the date above. Material changes will receive additional notice when required. Continued use after the effective date means you accept the revised Terms.

These Terms and incorporated policies are the entire agreement concerning the Services. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; xVPN may assign them as part of a reorganization or transfer of the Services.
